Declaration Concerning Life-Sustaining Procedures

What most people call a “living will” is formally named a Declaration Concerning Life-Sustaining Procedures under Louisiana Revised Statute 40:1151 et seq. The document takes legal effect when two physicians, one of them your attending physician, certify that you have a terminal and irreversible condition. At that point, it directs whether life-sustaining procedures should be withheld or withdrawn. It covers that specific decision and doesn’t authorize a proxy to manage your broader medical care.

Healthcare Power of Attorney

A healthcare power of attorney names a healthcare agent to make medical decisions on your behalf when you can’t make them yourself. This document works alongside a living will. What Happens Without Advance Directives

Louisiana law sets out a hierarchy of authorized decision-makers for incapacitated patients, but that hierarchy can produce conflicts. What Makes a Louisiana Living Will Legally Valid

Recording isn’t required by law, though you can file your living will with the Louisiana Secretary of State’s registry to make it more accessible to healthcare providers. If you travel out of state, Louisiana law doesn’t require recognition of your living will elsewhere, though providers typically treat a validly executed document as meaningful evidence of your wishes.
