What Is a Personal Injury?

Personal injuries are defined as any harm that is done to a person's body, mind, and/or emotions by the negligent or wrongful acts of another person or entity. Personal injuries can result from a variety of incidents, such as auto accidents, slip and falls, medical malpractice, workplace accidents, premises liability, dog bites, acts of violence, and more. In order to recover compensation for your injuries, you will need to prove that the person or entity that caused your injuries was negligent or acted wrongfully.

What Is Negligence?

To prove that a person or entity is liable for your injuries, you will need to demonstrate that they acted negligently. Personal injury law defines negligence as the failure to use the degree of care that a "reasonable person" would use in a given situation. If a reasonable person would have taken steps to avoid causing harm to another person, and that person failed to do so, they can be found negligent. This is true even if they did not intend to cause harm.

For example, if a person is driving and talking on their cellphone, they are failing to use the degree of care that a reasonable person would use. Even if they did not intend to cause harm to anyone, if they do cause harm, they can be found negligent.

What Damages Are Recoverable in a Personal Injury Case?

In Louisiana, personal injury claims are generally brought under the negligence legal theory, which requires proof that the defendant owed the plaintiff a duty of care, that they breached that duty of care, that the breach of duty caused an injury to the plaintiff, and that the plaintiff suffered actual damages as a result of the defendant's negligence. In personal injury claims, actual damages are commonly defined as economic losses and non-economic losses. Economic losses are quantifiable losses, such as medical expenses, lost wages, property damage, and other expenses that can be easily calculated. Non-economic losses are more difficult to quantify, such as pain and suffering, emotional distress, and other intangible losses. In Louisiana, non-economic damages are capped at $350,000, unless the plaintiff is a minor child or elderly person, in which case there is no cap.

Damages that are commonly recovered in a personal injury claim include:

  • Medical expenses
  • Future medical expenses
  • Lost wages
  • Property damage
  • Pain and suffering
  • Emotional distress
  • Loss of consortium
  • Punitive damages

Louisiana law requires that all personal injury claims be brought within two years of the date of the incident. If you are injured by a product that you purchased, however, you have four years from the date of purchase to file a claim. If you are injured by a government entity, you have three years from the date of the incident to file a claim.
