What Is a Personal Injury?

What Damages Are Recoverable in a Personal Injury Case?

In Louisiana, personal injury claims are generally brought under the negligence legal theory, which requires proof that the defendant owed the plaintiff a duty of care, that they breached that duty of care, that the breach of duty caused an injury to the plaintiff, and that the plaintiff suffered actual damages as a result of the defendant's negligence.
